These Terms of Use ("Terms") govern your use of virtugridusa.com and virtualpowerplantusa.com (the "Site"), operated by VirtuGrid, LLP ("VirtuGrid," "we," "us," or "our"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

What the Site is — and isn't

The Site provides general information about VirtuGrid's home battery and energy program and lets you check whether your home may qualify. Nothing on the Site is an offer to sell electricity, a contract, or a promise of eligibility. Electricity is supplied in partnership with licensed energy providers in each market we serve.

If you enroll, your program is governed only by the written program agreement you sign. Rates, terms, equipment, savings, and availability vary by state and market. If anything on the Site differs from your signed agreement, the agreement controls.

Estimates and savings

Rates, savings, backup-duration figures, and other numbers on the Site are illustrative estimates, not guarantees. Actual results depend on your utility, plan, household usage, home, weather, and energy-market conditions.

Eligibility checks

Results from our online eligibility check are preliminary. Final eligibility is confirmed only after an assessment of your home and your acceptance of the program agreement.

Information you provide

You agree to give accurate information, and to submit a request only for a home you own or are authorized to act for. You must be at least 18 years old to use the Site. How we handle your information is described in our Privacy Policy, and our text messages are covered by our SMS Terms.

Acceptable use

Please don't misuse the Site. That includes submitting false or someone else's information, interfering with the Site's operation or security, or using automated tools to copy or collect content or data from it.

Our content

The VirtuGrid name, logo, text, graphics, and video on the Site belong to VirtuGrid or its licensors. You may view and share pages for personal, non-commercial purposes, but you may not copy, modify, or reuse them commercially without our written permission.

Links to other sites

The Site links to outside sources, such as government energy data. We aren't responsible for the content or practices of sites we don't operate.

Disclaimer

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties about the Site, express or implied, including warranties of accuracy, fitness for a particular purpose, and uninterrupted availability. This section doesn't limit any warranties in a program agreement you sign.

Limitation of liability

To the fullest extent permitted by law, VirtuGrid is not liable for indirect, incidental, special, or consequential damages arising from your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.

Changes

We may update these Terms from time to time. The "Effective date" above shows when they were last revised. Continuing to use the Site after a change means you accept the updated Terms.
